I am delighted to be serving as the Program Chair and Moderator of “How to Improve Your Mediation Advocacy in Employment Litigation” on June 7, 2018 from 12:00 noon to 1:45 p.m. PDT presented by the ABA Section of Dispute Resolution and the Bar Association of San Francisco at the BASF offices at 301 Battery Street in San Francisco and webcast nationally. I will moderate the highly interactive panel roundtable discussion. The highly experienced panel consists of Mediator and Arbitrator Ruth Glick, plaintiff attorney Therese Lawless of Lawless & Lawless, defense attorney Brian Ashe of Seyfarth Shaw and Senior Corporate Counsel Jorja Jackson of Salesforce.

In a roundtable discussion format, focusing on wage-hour, wrongful termination, discrimination and sexual harassment matters, including the differences between single plaintiff, class action and PAGA cases, the panel will discuss the typical steps in an employment mediation:

  • Effective mediation memoranda and pre-hearing conferences

  • Effective oral presentations

  • Handling emotional issues

  • Identifying best, worst and most likely alternatives to a negotiated agreement

  • Opening offers and settlement moves

  • Avoiding or breaking impasse and closing the dea

  • Non-monetary issues, including apologies, reference letters and reinstatement

Each panelist plans to prepare materials on “Ten Tips for a Successful Employment Mediation”, written from their perspective.
